No, the issue is whether this is in violation of the list rules.

Whether it's an advertisement or not is irrelevant to the issue of whether it is copyrighted material (as is whether you personally have a copy or not). Copyright is determined by many things but whether something is or isn't an advertisement is not one of them. I agree that it would seem odd for ADV to mind but then I think it's odd that NBC minds about people posting clips of funny sketches on Saturday Night Live. Such is the wonderful world of copyright.

The mailing list rules (the most recent copy I could find via Google are here: http://eva.onegeek.org/pipermail/oldeva/2000-June/035671.html) don't specifically refer to video but do state in respect of audio files:

'Don't request or offer audio files. These are copyrighted, and audio piracy is illegal.'

I think it's safe to say the intention was to cover all copyrighted material. Ebj's point was that once you had ascertained a list member had a copy of the file you wanted, if you wanted to ask for a copy then that should be a private matter. Doing it on list is violation of the rules you agree to when you join the mailing list.
