i don't see how that's possible, in this case.
i don't know the full details of the history of broadcast in japan, but as 
far as i can tell this tape was

(a) taped off WOWOW (or so i've been told) and
(b) contains death and rebirth (so the eyecatches and titling sequences 
would have it. it ends with tamashii no rifuran as the eva series appears 
over asuka. not to mention i know EoE when i see it.)

so either it *was* broadcast on WOWOW or whoever told me they taped it off 
WOWOW was wrong. i seem to remember a WOWOW logo at the beginning of the 
tape, but i didn't actually bother rewinding it (or watching it) past the 
beginning of rebirth. either way, the tape definitely contains death & 
rebirth. and it doesn't really matter what cut of death, since i didn't take 
that into consideration for the review.

it doesn't ^_^;;

because:

(a) my VHS tape contains something which is labeled as rebirth
(b) i can assume that, whatever the source, it isn't a clever forgery
(c) i own the japanese LD genesis 0:13
(d) meaning i can recognize Air very, very well by now.
(e) Air and rebirth are reputed to have differences in soundtrack and 
animation
(f) the manga DVD has no differences from my japanese LD of Air (except 
credits and title cards, which would be easy enough to edit in)
(g) my VHS rebirth has differences from my japanese LD of Air (BGM and 
animation as well as credits and title cards)
(h) manga has practical reasons to just stuff the first chunk of EoE onto 
the DVD instead of the real rebirth. (the dub for EoE probably wouldn't 
synch properly to rebirth. saves a lot of money and time.)

incidentally, i am not the first person to have noticed this. i don't know 
the URL, but there's a review of the european discs which laments the same 
thing, which lent credence to my supposition before i even wrote my review.

basically, i first watched the disc and my suspicions were aroused because 
i'd remembered hearing that there were differences between rebirth and air, 
but the manga disc had none. then i went onto the AoD forums, and read that 
there had been a review of the french release which said that this wasn't 
rebirth at all. i dug in my closet, found my tape, and verified that rebirth 
was not the same as what was on this DVD. i feel comfortable saying this.
